Board Meeting
July 27,  2004
5:00 p.m.

The meeting was called to order by the Vice-President, Presley Burns at 5:00 p.m.
Old Business:
1).  Stumps are still being removed
2).  Trash still present on patio of D15, so another letter and fine will be issued. Arrangements will be made for someone to go over the wall and retrieve and dispose of the trash, and cost to do so will be charged to the owner as well.
3). Bart will follow-up on status of installing new patio doors on units E7 and E9. He thought E9 had been repaired, rather than replaced.
4).  New boards are to be installed on parts of the boardwalk below the pool but this has not been done yet.
5).  Stucco patching has been done in some areas, but now that the pressure washing is complete, all areas requiring patching will be addressed in the near future.
6).  C10 is still not locking their mailbox.  Fines will be imposed.
7).  Bart has reviewed the list of proposed remodeling projects for E9 and approved same.
8).  An update of satellite dishes requiring removal and/or relocation was presented.  Final notification letters allowing ten days to comply with rules will be sent out this week indicating those not in compliance will face a $25 fine every two weeks.

New Business

1).  Michael Schwartz, Unit C3, addressed the board members regarding water damage in the unit below his owned by Wess Brasher (C1) and wanted to know what the Association's position on this problem was.   Mr. Schwartz expressed his concern over the fact that when he looked at his unit while it was on the market (owned then by Gifford) the latter part of May, he specificially asked the agent whether there had been any issues with leaks and was told no (selling agent Wess Short, purchaser's agent unknown).  On July 1st, Metcalf had been called by Mr. Brasher (C1)about water damage his unit was sustaining which he thought was coming from the roof as a result of rain.  Metcalf checked the roof and found no leaks and asked Brasher to keep them advised.  Metcalf was again called by Mr. Brasher on 7/14 who said when he woke up about 6:30 a.m. he again noticed a leak and could hear water coming from the shower above.  Metcalf, after investigating, deemed that the water was coming from Mr. Schwartz's bathtub (splashing from the shower onto the floor) and leaking down to C1.  Metcalf caulked and put up a shower dam in Mr. Schwartz's tub and felt like this would alleviate the problem temporarily.  Mr. Schwartz is now aware that previously there had been a problem with C3's bathroom causing damage to C1, and felt like this should have been disclosed by the real estate agent when he asked.  Although he had his unit inspected prior to purchase, the inspection did not disclose any problems.  He expressed his desire to work with Mr. Brasher to repair any damages, and that he would inform his insurance agent and real estate agent, and seek legal counsel as to how he should proceed in the matter.  He was told by the Board members that this would be the recommended course of action.

2).  The Board discussed, and reached a decision, on the amount of money to be paid for the pressure washing completed recently by Patty Barnett.  It was agreed that those areas requiring such, could be done twice annually.

3).  The quotation from Barnes Building Services to install a drain above the B-row was reviewed and discussed.  It was decided at this time to utilize the concrete barriers presently in place.  The issue of the proposed drain will be addressed in the next fiscal year.

4).  Barnes Building Services also presented a quotation on replacing all the railroad ties bordering 33rd Street with geo-stones.  This issue will also be addressed in the next fiscal year.

5).  The door and tiles on the porch between B5-B6 will be discarded.

6).  It was discussed that B15 has undertaken some remodeling without approval of the board.  And, this unit is venting their clothes dryer out the bedroom window.  Metcalf will address these issues with the owner.

7).  Discussion took place concerning board members who have missed more than two meetings without advance notification should be removed from the board.  A vote was then taken to remove two board members for this reason, being Shirley Williams and Janet Roberts.
